01Acceptance of Terms

These Terms & Conditions (“Terms”) form a legally binding agreement between you (“you”, “User”) and the operator of EARobot FX (“we”, “us”, “our”). They apply to your use of this website, your account, and every product or service we offer (together, the “Service”).

By browsing the website, creating an account, or completing a purchase, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

02Eligibility

You must be at least 18 years old, or the age of majority in your country, whichever is higher, to use the Service. If you use the Service on behalf of a company, you confirm that you are authorised to bind that company to these Terms.

We may refuse or cancel service to anyone who breaches these Terms or applicable law.

03Products and Services

EARobot FX sells digital trading tools for the MetaTrader 4 (MT4) and MetaTrader 5 (MT5) platforms, such as Expert Advisors (EAs), indicators, scripts, presets and related software, together with setup tutorials and support. We may also accept requests for custom EAs or indicators, which are quoted and delivered separately.

Product descriptions, features, versions and availability may change without notice. We describe our products in good faith but do not warrant that descriptions are complete or error-free, and we may update, replace or discontinue any product at any time.

04Pricing and Payment

Prices are shown in Malaysian Ringgit (MYR) unless stated otherwise. The price displayed at checkout is the final price you pay, after any valid coupon or discount. Payment is due in full when you place the order.

Available payment methods are shown at checkout and may include online banking (FPX), credit/debit cards, PayPal, cryptocurrency and your wallet balance. Payments are processed by independent third-party providers; we do not store your full card details.

If a pricing error occurs, we reserve the right to correct the price before the order is processed.

05Licences, Activation and Account Binding

Most of our EAs and indicators are protected by a licence that is checked online. Your licence is tied to the conditions shown in your order and in My Licenses, which may include:

• the platform (MT4 and/or MT5) the licence is valid for;
• the number of live and demo trading accounts, and the number of computers/VPS the product may run on;
• the brokers on which the product may be used; and
• the licence expiry date, if any.

When a product starts, it sends technical information to our licence server (see our Privacy Policy) so that the licence can be verified. Using a product on accounts, devices or brokers outside your licence, sharing your licence, or trying to bypass the licence check is a breach of these Terms and may lead to immediate suspension of the licence without refund.

Changes to a licence, such as adding an account or switching platform, are subject to the product's rules and may need our approval.

06Delivery and Downloads

After payment is confirmed, your product and licence become available in your account (Downloads and My Licenses) and may also be sent to the email address you provided. You are responsible for giving us a correct and reachable email address and for checking your spam folder.

Download links and the number of downloads may be limited for security. Please save and back up your files once downloaded. We do not guarantee that a product will remain available for re-download indefinitely, although we will make reasonable efforts to keep purchased products accessible while your account is active.

We are not responsible for delivery delays caused by incorrect contact details, email filtering, or problems at your email provider or payment provider.

07Refund Policy

Because our products are digital and can be copied once delivered, all sales are final and no refunds are given once an order has been purchased. This applies whether or not the product has been downloaded, and whether or not the licence has been issued or activated.

We do not give refunds for change of mind, accidental purchases, lack of trading profit, or incompatibility with your broker, device or strategy. Please read the product description and ask us any questions before you buy.

If you have a technical problem with a product or licence, please contact our support team. We will do our best to help you fix it, but a technical issue does not entitle you to a refund.

By placing an order, you agree to this Refund Policy. Filing a chargeback or payment dispute for a completed order, instead of contacting us, may lead to suspension of your account and licences.

08Wallet Balance and Top-ups

You may top up a wallet in your account and use the balance to pay for orders on this website. Wallet balance is a prepaid credit for purchases on EARobot FX only. It is not a bank account or a deposit, does not earn interest, and cannot be transferred to another user.

Top-ups are processed by our payment providers and are credited once payment is confirmed. Unless required by law or approved by us in a specific case, wallet balance is not withdrawable as cash. We may suspend or reverse wallet credit that was obtained through error, fraud or a chargeback.

09Referral Programme

If a referral programme is offered, you may earn commission when a new customer who uses your referral code or link completes a qualifying paid order. Commission rates, tiers and conditions are shown in your referral dashboard and may change from time to time.

Self-referrals, fake accounts, spam, misleading promotions, and any attempt to manipulate the programme are not allowed. We may withhold, cancel or reverse commission, and close the account, where we reasonably suspect abuse or where the underlying order is charged back or reversed by the payment provider.

10Intellectual Property and Licence Restrictions

All products, source code, compiled files, strategies, text, graphics, tutorials, branding and website content are owned by us or our licensors and are protected by copyright and other laws. Buying a product gives you a limited, non-exclusive, non-transferable, revocable licence to use it for your own trading, under the conditions of your licence. You do not receive ownership.

Unless we agree in writing, you must not:

• copy, resell, share, rent, lease, upload or otherwise distribute any product, licence key or download link;
• decompile, reverse-engineer, modify, crack or remove protection from any product or its licence check;
• use a product to build, train or sell a competing product or signal/copy-trading service;
• remove or alter copyright, trademark or licence notices.

Breach of this section may lead to immediate licence termination, account closure without refund, and legal action.

11Trading Risk Disclaimer

Our products are software tools. They are not financial advice, not an investment recommendation, and not a guarantee of profit. We are not a broker, fund manager or licensed investment adviser, and we do not manage your money or trade on your behalf.

Any results, statistics, back-tests, screenshots or testimonials we or others show are for illustration only. Past performance, including back-test or demo results, does not indicate future results. Real results depend on your broker, spreads, execution, VPS, settings, lot size, market conditions and many other factors that we do not control.

You are solely responsible for your trading decisions, your settings, your risk management and any gains or losses. We strongly recommend testing any product on a demo account first.

12User Responsibilities

You agree to use the Service lawfully and honestly. You must not:

• give false or misleading information when registering, ordering or requesting support;
• use bots, scrapers or scripts to access the Service, or attempt to break into our systems, licence server or other users' accounts;
• interfere with the security, performance or availability of the Service;
• upload malware, or harass, threaten or abuse our staff or other users; or
• use the Service in a way that breaks any law, or your broker's or regulator's rules.

You are responsible for making sure that using trading software and automated trading is allowed in your country and by your broker.

13Account Security

You are responsible for keeping your password and account safe, and for all activity under your account. Please tell us immediately if you suspect unauthorised access. We are not liable for loss caused by your failure to protect your credentials. Accounts and licences may not be sold or transferred to anyone else without our written consent.

14Third-Party Services

The Service relies on third parties such as payment gateways, email providers, hosting providers, MetaTrader platforms and brokers. They operate under their own terms and privacy policies and we do not control them. We are not responsible for their services, outages, fees or decisions, including a broker restricting the use of EAs on your account.

15Disclaimer of Warranties

To the fullest extent permitted by law, the Service and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service or any product will be uninterrupted, error-free or secure, that every defect will be corrected, that a product will work with every broker, account type, platform build or VPS, or that it will meet your expectations or produce any particular result.

16Limitation of Liability

To the maximum extent permitted by law, we and our directors, employees, partners and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, trading loss, loss of data or business interruption, arising from your use of, or inability to use, the Service or any product, even if we were told such loss was possible.

Our total liability to you for all claims relating to the Service is limited to the amount you actually paid us for the product or order that gave rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

17Indemnification

You agree to indemnify and hold us harmless from claims, losses, liabilities and reasonable legal costs arising from your breach of these Terms, your misuse of any product or licence, your trading activity, or your violation of any law or third-party right.

18Suspension and Termination

We may suspend or terminate your account, licences or access to the Service, with or without notice, if you breach these Terms, abuse the licence system or referral programme, commit fraud or chargeback abuse, or if required by law. On termination your right to use the products ends, and no refund is due where the termination results from your breach.

You may stop using the Service at any time. You may ask us to close your account by contacting us (see the Privacy Policy for how we treat your data).

19Changes to the Service and These Terms

We may change, suspend or discontinue any part of the Service, and we may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Service after a change means you accept the updated Terms. Changes do not affect orders already completed, except where required by law.

20Governing Law and Disputes

These Terms are governed by the laws of Malaysia. We encourage you to contact us first so that we can try to resolve any dispute in good faith. If a dispute cannot be resolved within 30 days, it will be subject to the exclusive jurisdiction of the courts of Malaysia.

21General

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy and any policies published on the Service, are the entire agreement between you and us about the Service. We may transfer our rights under these Terms to a successor of the business.
